Who posts the preapproved ADU plans California law requires?
Since January 1, 2025, every California local agency — 540 cities, towns and counties — must run a program for the preapproval of accessory dwelling unit plans and post the preapproved plans on its own website (Cal. Gov. Code § 65852.27, added by Stats. 2023, ch. 759, amended by Stats. 2024, ch. 7 (SB 477)). We checked a random sample of 540 agencies. 119 of them had preapproved plans posted.
Every agency this scan has found with plans posted is in the statewide plans catalog — a resource any other agency can use to adopt already-approved plans under § 65852.27(a)(5).

What the law requires
AB 1332 (AB 1332 (Carrillo), Chapter 759, Statutes of 2023) added Section 65852.27 to the Government Code. Its terms, quoted from the statute:
- “Each local agency shall, by January 1, 2025, develop a program for the preapproval of accessory dwelling unit plans.” That deadline passed more than eighteen months ago.
- The program must accept plan submissions and “shall not restrict who may submit accessory dwelling unit plan submissions for preapproval.”
- “Accessory dwelling unit plans that are preapproved pursuant to this subdivision shall be posted on the local agency’s internet website.” The agency must also post the plan applicant’s contact information.
- Applications for a detached ADU using a preapproved plan get a 30-day ministerial approval clock, half the normal 60 days.
“Local agency” means “a city, county, or city and county, whether general law or chartered” (Gov. Code § 66313), and the section states expressly that it “applies to all cities, including charter cities.” Enforcement runs through housing-element law: AB 434 (Ch. 740, Stats. 2023) amended Gov. Code § 65585 so HCD may issue notices of violation for noncompliance with state ADU law and refer violations to the Attorney General.

Method
The universe is the 540 California local agencies the statute covers: every incorporated city and town, every county, and the consolidated City and County of San Francisco counted once. The sample is 540 agencies drawn in two rounds by simple random sample with fixed seeds (104104, 104105, 104106, 104107, 104108, 104109, 104110, 104111, 104112, 104113, 104114, 104115) over the full agency list sorted alphabetically (round two excludes round one’s agencies before drawing), so the draw can be reproduced. For each agency we searched the agency’s own website and fetched its planning or building pages for a preapproved, permit-ready or standard-plan ADU program, and where a program page exists, checked whether preapproved plans are actually posted on it.
Judgments are conservative in both directions. A page that promises a program or says plans are coming is scored short of the posting requirement; an agency we could not verify — an unreachable site, blocked pages, an ambiguous match — is reported as unverified, never as a negative. Per-agency findings from web scanning of this kind have a measured error rate in our own prior work, which is why the aggregate numbers, not any single row, are the finding. The pattern
The statute asks for very little that is technically hard: a program page, an intake path, and a posted plan library. What agencies actually publish is usually one of the pieces — an ADU information page with no preapproval program, a program adopted on paper with no plans posted, or a plans page taken offline pending a building-code cycle update. The web surface the statute names is the missing part, and it is the part a third party can build and maintain.

The annual keeps it compliant: hosting, intake handling, a quarterly refresh, and plan revalidation each building-code cycle — a posted plan drawn to a superseded code edition is a compliance gap that looks like compliance, and it is the most common one we find.
Both charges sit under typical municipal informal-purchasing thresholds, so most agencies can buy without a formal bid process. The alternative is consultant time that builds the page once and hands you a file that goes stale at the next code cycle. Card, ACH, purchase order, or annual invoice all work.
